§1. General provisions
- These Terms govern use of the ParkWise mobile app and website parkwise.pl (together referred to as the “Service”).
- The service provider is Damian Kostarczyk, Poznań, Poland, email: kontakt@parkwise.pl.
- Starting to use the Service constitutes acceptance of these Terms.
§2. Nature of the Service
- ParkWise is a community parking map based on user-generated content.
- The Service does not guarantee that parking information is current, correct or lawful. Data is added by other users and may be outdated, incomplete, incorrect or concern places where parking is prohibited.
- Users park at their own risk. The Service is not liable for fines, towing costs, damage or other losses resulting from parking in a place marked as “parking” on the map.
§3. Registration and user accounts
- An account is required to use all app features.
- Registration requires a username, email address and password.
- The account must be activated through the link emailed after registration (valid for 24 hours).
- Users must provide truthful information and keep their password secure.
- If a password is forgotten, “Forgot password” sends a link to the account email address for setting a new password (valid for 1 hour).
- One person may not create multiple accounts.
§4. Rules of use
The user agrees to:
- Add reliable parking information reflecting the actual situation
- Not mark places as “parking” where parking is prohibited by law
- Not publish offensive, vulgar or unlawful content, infringe personal rights, or promote hatred or violence
- Not publish pornographic or graphic content or promote psychoactive substances or unlawful activity
- Respect copyright when adding photos (take them yourself or use photos free of rights)
- Not post advertising, spam or commercial content
- Not attempt to bypass app security
- Not abuse reports (for example reporting parking without reason to harass other users)
§5. User-generated content and moderation
- Any logged-in user may add photos to any parking in the Service, not only their own places.
- Any logged-in user may report parking that breaches the Terms using “Report parking”, specifying a reason (spam, indecent content, not a parking place, outdated information, other) and optionally adding a comment.
- When the report threshold (5 reports) is exceeded, parking is automatically hidden from the map until the administrator reviews the report.
- The administrator reviews reports within a reasonable time and takes one of the following actions:
- Reject the report (false alarm) — parking remains visible
- Restore visibility — if reports were unfounded
- Permanently delete parking with its photos and comments
- Users cannot report parking they added themselves.
- Each user may report the same parking only once.
- Users with an active block cannot add or report content.
§6. Moderation and blocks
- Administrators may moderate content by deleting comments, photos and parking that breach the Terms.
- For serious or repeated breaches, the administrator may restrict account permissions (disable adding, commenting or rating) or temporarily block the account.
- Users may appeal a block through the form in the app.
- Administrator decisions are made in good faith based on user reports and their own assessment of content.
§7. Intellectual property
- By adding photos, comments or other content, users grant the service provider a free, non-exclusive, indefinite licence to use it within the Service.
- Users retain copyright in their contributions.
- The licence expires when the user or administrator deletes the content.
- When an account is deleted, its parking, photos and comments remain anonymous in the Service — see §11.
§8. Advertising
The app displays Google AdMob advertising to fund free access to its services.
§9. Liability
- The service provider endeavours to operate the Service correctly but does not guarantee uninterrupted availability.
- The provider is not liable for consequences of using parking information added by users.
- The provider is not liable for user-generated content, but undertakes to remove it promptly after receiving a report of a breach of the Terms or law.
§10. Personal data
Personal data processing is described in the Privacy Policy.
§11. Account deletion
- The user may permanently delete their account at any time in two ways:
- In the app: “My profile” → “Account” → “Delete account” → confirm with password
- On the website: parkwise.pl/usun-konto.html — a form requiring your login/email and password
- After account deletion:
- Permanently deleted: login, email address, hashed password, avatar, profile description (bio), parking ratings added by the user
- Anonymised (remain in the Service without a link to the account): added parking, photos, comments and reports. These contributions have community value; keeping them anonymous maintains information for other users
- Account deletion is irreversible. The account and deleted data cannot be restored afterwards.
- If technical problems prevent self-service account deletion, the user may contact the administrator at kontakt@parkwise.pl.
§12. Changes to the Terms
The provider reserves the right to amend these Terms. Users will be informed of significant changes by email or in the app.
§13. Final provisions
- Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and GDPR.
- Disputes are resolved by the court with territorial jurisdiction over the provider's place of residence (Poznań).
